These Terms of Service govern your access to and use of our services.
Acceptance of Terms
By accessing or using our services, you agree to be bound by these terms.
Account Registration
When you create an account with us, you must provide accurate information and keep it updated. You are responsible for maintaining the security of your account.
Platform and Usage
Villo is a peer-to-peer marketplace for camera gear. We connect Owners (who list items) and Renters (who book items), but we do not own any equipment nor do we act as the actual rental provider. Villo’s role is to facilitate listings, identity verification, and payments. All bookings, transactions, and rental arrangements happen directly between users; Villo is not a party to rental contracts. As such, Owners are solely responsible for the condition and description of their gear, and Renters are responsible for proper use and care of rented items. Owners and Renters may choose to opt into an optional Damage Protection Plan (described below) for damage coverage, but in all cases Villo remains only a facilitator of the rental process.
"As-Is" Condition and No Warranty
All gear is provided to renters “as-is” by its owner. Villo makes no promises or guarantees about any item’s quality, safety, or fitness for a particular purpose. You acknowledge that Owners, not Villo, list the gear and that we do not inspect or certify each item. Renters should inspect equipment upon receipt and report any issues immediately. Because items are independently offered, you bear the risk for any defects or damages. Villo expressly disclaims all warranties (express or implied) regarding equipment and transactions; no warranties are provided beyond what owners supply.
User Conduct and Age
By using Villo for renting equipment you represent that you are at least 18 years old and legally capable of entering contracts. You agree to use the platform only for lawful, appropriate purposes (no fraud, theft, or illegal use of equipment). You must keep your account credentials secure and are responsible for all activity on your account. Villo may require all users to submit valid identification (government-issued ID, proof of address, etc.) for identity verification before they can list or rent items. Refusing to provide requested verification or providing false information may lead to account suspension.
Payment Processing
All payments between Renters and Owners are handled through the Stripe payment gateway. Villo does not store your credit card or bank account numbers – these are securely processed by Stripe under industry-standard encryption. You authorize Villo to charge your chosen payment method for rental fees, security deposits, and any applicable fees as set by the Owner. Villo may also place temporary holds on a Renter’s payment method for security or damage claims purposes (for example, see the Damage Protection Plan below). You agree that disputes over payment or refunds must be resolved through Villo’s payment system and Stripe’s policies. Villo is not responsible for payment errors or Stripe’s handling of transactions, though we will assist with reasonable efforts.
Optional Coverage and Cost
Renters may opt into a Damage Protection Plan by paying an additional fee equal to 10% of the rental cost. This plan covers accidental damage to the rented gear caused by the Renter during the rental period. Under the plan, Villo will pay up to 30% of the item’s replacement value for repair or replacement of covered damage. If the repair cost is less than 30% of the replacement value, the plan will cover the full cost of that damage. Any damage costs above the covered amount are the Renter’s responsibility. If a Renter chooses not to opt in, the Renter remains fully responsible for any damage to the gear. Claim Process and Requirements: To use the plan, the Renter should provide clear photos of the gear’s condition at the start of the rental (before pickup). The Owner should upload photos upon return to document any damage. The Owner must report any damage to Villo within 24 hours of rental completion through Villo’s dispute process. If a valid damage claim is filed, Villo may place a temporary hold on the Renter’s payment method for the full replacement value of the item. Villo will then review the claim. If approved, Villo will apply plan funds (up to 30% of replacement value) for repairs or replacement and charge any remaining covered damage cost (beyond the plan coverage) to the Renter. If the claim is not approved or is withdrawn, the hold will be released and no funds will be charged. Exclusions and Limitations: The Damage Protection Plan covers only accidental damage caused by the Renter. It does not cover theft, loss, intentional damage, normal wear and tear, or any damage not reported according to the requirements above. Villo is not an insurer, and its liability under this plan is strictly limited to the terms described here. All of Villo’s standard disclaimers and limitations of liability (below) continue to apply to any losses outside the scope of this plan.
Renter Liability for Theft, Loss, and Uncovered Damages
The Renter is fully and solely responsible for any theft, loss, or damage to the rented gear that is not covered under Villo’s Damage Protection Plan. This includes, but is not limited to, gear that is stolen, misplaced, intentionally damaged, or otherwise not returned to the Owner in its original condition. In the event of theft or loss, Villo may place a temporary hold on the Renter’s payment method for up to the full replacement value of the item. If the gear is not recovered or returned in acceptable condition, the Renter authorizes Villo to charge their payment method for the full replacement value. Villo does not provide insurance for theft or loss, and all liability for such incidents rests solely with the Renter. Villo Protection Plan is waived if theft or loss occurs.
Return of Gear and End of Rental Period
The Renter is required to return the rented gear directly to the Owner at or before the scheduled end of the rental period. Failure to return the gear on time constitutes an unauthorized extension of the rental and may result in additional fees, holds, or charges up to the full replacement value of the item. If the Renter does not return the gear within 24 hours of the scheduled return time, the item may be considered lost or stolen, and Villo may initiate its loss or theft procedures, including placing a hold on the Renter’s payment method and charging the replacement value. Continued possession of gear beyond the rental period is not permitted and does not grant the Renter any right of continued use or ownership.
Indemnification
You agree to indemnify and hold Villo and its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the platform, (b) your violation of these Terms, or (c) your violation of any rights of any third party (including without limitation claims of damage by any person or entity). This means if another user or third party sues us because of something you did on Villo, you are responsible for the costs of defending us and any resulting damages.
Your Content
You retain ownership of content you create and share through our services.
Liability and Release
Villo is strictly a technology platform and is not liable for any loss, damage, theft, or injury arising from rentals. You understand and agree that, to the fullest extent permitted by law, Villo disclaims all liability for any claims related to items rented through the platform. This includes damage to equipment, personal injury, or other losses caused by any user or third party. In other words, you use Villo at your own risk. As is common in peer-to-peer rental services, you agree to release and hold harmless Villo from any claims arising out of a rental (except in cases of Villo’s own gross negligence or willful misconduct). (Note: The optional Damage Protection Plan described above is offered solely for the benefit of the Renter and Owner under those specific terms; Villo’s liability remains limited as stated in these Terms even if the plan is purchased.)
Modification and Termination
Villo reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the revised Terms on the platform or sending a notice. Your continued use of Villo after such updates will signify your acceptance of the new terms. Villo also reserves the right to suspend or terminate accounts at our discretion for violations of these Terms, suspicious activity, or any other reason as permitted by law. If your account is terminated, your licenses to use the platform end immediately but any outstanding obligations (such as payment or damage claims) will survive.
Governing Law
These Terms are governed by the laws of the United States (and applicable state laws). Any dispute arising under or relating to these Terms or the rental transactions will be resolved exclusively in the federal or state courts located in the United States. You agree to submit to the personal jurisdiction of these courts and waive any jurisdictional objections (such as forum non convenient objections) to venue and jurisdiction in these courts.
